In many cases of criminality within large corporations, senior management does not commit the operative offense—or conspire or assist in it—but nonetheless bears serious responsibility for the crime. That responsibility can derive from, among other things, management’s role in cultivating corporate culture, in failing to police effectively within the firm, and in accepting lavish compensation for taking the firm’s reins. Criminal law does not include any doctrinal means for transposing that form of responsibility into punishment. Arguments for expanding doctrine—including broadening (...) of the presently narrow “responsible corporate officer” doctrine—so as to authorize such punishment do not fare well under the justificatory demands of criminal law theory. The principal obstacle to such arguments is the large industrial corporation itself, which necessarily entails kinds and degrees of delegation and risk-taking that do not fit well with settled concepts about mens rea and omission liability. Even the most egregious and harmful management failures must be addressed through design and regulation of the corporation rather than imposition of individual criminal liability. (shrink)

A typescript by Claude Shannon, ‘Theorems on statistical sequences’, is examined to shed light on the development of information theory. In particular, it appears that Shannon was still working out the mathematical details of his theory in the spring of 1948, just before he published ‘A mathematical theory of communication’. This is contrasted with evidence from a declassified cryptography report that Shannon’s theory was intuitively worked out in its essentials by the time he filed the report in 1945. Measurements of the ac electrical resistance as a function of temperature and applied magnetic field R were made for various compositions x≲0.03 in the mixed binary system Be13. All samples within this range of x exhibit heavy Fermion superconductivity with a superconducting transition temperature Tc that is rapidly suppressed by the substitution of Th for U. Ethical codes help guide the methods of research that involves samples gathered from?at-risk? populations. The current article reviews general as well as specific ethical principles related to gathering informed consent from partner violent offenders mandated to outpatient treatment, a group that may be at increased risk of unintentional coercion in behavioral sciences research due to court mandates that require outpatient treatment without the ethical protections imbued upon prison populations. Recommendations are advanced to improve the process of informed consent within this (...) special population and data supporting the utility of the recommendations in a sample 70 partner violent offenders are provided. The rate‐limiting step in the uptake and metabolism of Dglucose by insulin target cells is thought to be glucose transport mediated by glucose transporters (primarily the GLUT4 isoform) localized to the plasma membrane. However, subcellular fractionation, photolabelling and immunocytochemical studies have shown that the pool of GLUT4 present in the plasma membrane is only one of many subcellular pools of this protein. GLUT4 has been found in occluded vesicles at the plasma membrane, clathrin‐coated pits and vesicles, early endosomes, and tubulo‐vesicular (...) structures; the latter are analogous to known specialized secretory compartments. Tracking the movement of GLUT4 through these compartments, and defining the mechanism and site of action of insulin in stimulating this subcellular trafficking, are major topics of current investigation. Recent evidence focuses attention on the exocytosis of GLUT4 as the major site of insulin action. Increased exocytosis may be due to decreased retention of glucose transporters in an intracellular pool, or possibly to increased assembly of a vesicle docking and fusion complex. Although details are unknown, the presence in GLUT4 vesicles of a synaptobrevin homologue leads us to propose that a process analogous to that occurring in synaptic vesicle trafficking is involved in the assembly of GLUT4 vesicles into a form suitable for fusion with the plasma membrane. Evidence that the pathways of signalling from the insulin receptor and of GLUT4 vesicle exocytosis may converge at the level of the key signalling enzyme, phosphatidylinositol 3‐kinase, is discussed. A novel argument for the existence of God is presented, based on demonstrating that prior to its puzzling emergence, the seven-day week was unimaginable, undesirable, and (socially) infeasible. Indeed, we argue that game theory reveals that the launch of a Sabbath-cycle, like the seven-day week initially was, cannot have occurred without extra-human support. The argument gains additional force by a) noting how the Pentateuch is an insightful “sociological witness” to the infeasibility of the Sabbath-cycle’s inauguration; b) integrating it with the (...) (weaker, but complementary) Kuzari argument, on the infeasibility of propagating a false myth of mass revelation; c) considering two unattested possibilities—that a human king might legislate a Sabbath-cycle and that it might emerge via an iterated game; and d) noting theologically attractive features of the argument, including that the week’s spread means that a divine gift to one people became a blessing for humankind. An important part of our Theory of Mind—the ability to reason about other people's unobservable mental states—is the ability to attribute false beliefs to others. We investigated whether processing these false beliefs, as well as similar but nonmental representations, is reliant on language. Participants watched videos in which a protagonist hides a gift and either takes a photo of it or writes a text about its location before a second person inadvertently moves the present to a different location, thereby rendering (...) the belief and either the photo or text false. At the same time, participants performed either a concurrent verbal interference task (rehearsing strings of digits) or a visual interference task (remembering a visual pattern). Results showed that performance on false belief trials did not decline under verbal interference relative to visual interference. We interpret these findings as further support for the view that language does not form an essential part of the process of reasoning online (“in the moment”) about false beliefs. (shrink)

Lambert Zuidervaart examines what is living and what is dead in the social philosophy of Theodor W. Adorno, the most important philosopher and social critic in Germany after World War II. When he died in 1969, Adorno's successors abandoned his critical-utopian passions. Habermas in particular, rejected or ignored Adorno's central insights on the negative effects of capitalism and new technologies upon nature and human life. Zuidervaart reclaims Adorno's insights from Habermasian neglect while taking up legitimate Habermasian criticisms. In the U.S.A., advocates of academic freedom—the ability to pursue research unencumbered by government controls—have long found sparring partners in government officials who regulate technology trade. From concern over classified research in the 1950s, to the expansion of export controls to cover trade in information in the 1970s, to current debates over emerging technologies and global innovation, the academic community and the government have each sought opportunities to demarcate the sphere of their respective authority and autonomy and assert themselves in (...) that sphere. In this paper, we explore these opportunities, showing how the Social Contract for Science set the terms for the debate, and how the controversy turned to the proper interpretation of this compact. In particular, we analyze how the 1985 presidential directive excluding fundamental research from export controls created a boundary object that successfully demarcated science and the state, but only for a Cold War world that would soon come to an end. Significant changes have occurred since then in the governance structures of science and in the technical and political environment within which both universities and the state sit. Even though there have been significant and persistent calls for reassessing the Cold War demarcation, a new institutionalization of how to balance the concerns of national security and academic freedom is still only in its nascent stages. We explore the value of moving from a boundary object to a boundary organization, as represented in a proposed new governance body, the Science and Security Commission. (shrink)

Theodor Adorno's Aesthetic Theory is a vast labyrinth that anyone interested in modern aesthetic theory must at some time enter. Because of his immense difficulty of the same order as Derrida - Adorno's reception has been slowed by the lack of a comprehensive and comprehensible account of the intentions of his aesthetics. This is the first book to put Aesthetic Theory into context and outline the main ideas and relevant debates, offering readers a valuable guide through this huge, difficult, but (...) revelatory work. Its extended argument is that, despite Adorno's assumptions of autonomism, cognitivism, and aesthetic modernism, his idea of artistic truth content offers crucial insights for contemporary philosophical aesthetics.The eleven chapters are divided into three parts: Context, Content, and Critique. The first part offers a brief biography, describes Adorno's debates with Benjamin, Brecht, and Lukács, and outlines his philosophical program. The second part is an interpretation of Adorno's aesthetics, examining how he situates art in society, production, politics, and history and uncovering the social, political, and historical dimensions of his idea of artistic truth. Effective Altruism is a movement and a philosophy that has reinvigorated the debate about the nature of beneficence. At base, it is the consistent application of microeconomic principles to beneficent action. The movement has exposed that many forms of giving do little good (or do active harm), but others do tremendous good. Questioning Beneficence uses Effective Altruism as a launchpad to ask hard questions about beneficence more generally. Must we be Effective Altruists, or is Effective Altruism and the ideas driving (...) the movement a mistake? How much should we give and-if anything-how should we give it? What are the respective roles of different kinds of institutions? Is charity anti-democratic and do billionaire philanthropists have too much power? Is Effective Altruism just utilitarianism in disguise? Questioning Beneficence is written by four philosophers, each with distinct points of view. It introduces a new standard for debating ideas in philosophy as each author poses and answers three questions and each of his three co-authors responds to those questions in turn. Finally, the first author replies to his co-authors' responses. Throughout the book, there is a spirit of curiosity, intellectual risk taking, and truth-seeking, rather than point-scoring and one-upsmanship. Questioning Beneficence demonstrates what open-minded, real dialogue over an important issue can be at its very best. (shrink)
